Adam Johnson
No not him, the Nottingham Panthers Hockey player.

The police have arrested someone for suspicion of manslaughter.

I thought it was a freak accident and I know of at least one other time it happened in the NHL, so it will be interested to see what unfolds?

Yes, end of his career with Boston and Brashear was with Vancouver.

irons, was the McSorley one with Brashear as the victim?

Re: Adam Johnson
Couple things

1) There is, Canadian at least, form for charges for on-ice incidents

2) One of the first things you learn playing hockey is never, ever, ever raised your leg. I can see proving intent with the amount that is drilled into you from an early age.

Look up Malarchuk for an accident from a skate on a goalie.

Ex-Oiler McSorely (he's 60 now, where has my life gone) got assault for this

https://www.youtube.com/watch?v=-gQ4_qDwSng

A BC judge gave him 18 months conditional, for Assault With a Weapon.

He is intent is obviously very clear, while it isn't as much in the Johnson death.

But as I said lifting your leg, is against everything you are taught.

In a discussion on TV with an NHL player not long after it happened they broke it down in slow motion and allegedly Petgrave kicks Johnson twice. It was shocking to see but at the same time you are thinking how on earth does his skate make contact twice at that speed. Do you make contact twice in a freak accident?!

Didn't big Dunc get charged with assault at a game in Scotland?

Good point. There's a fine line.

I would say in boxing, if a boxer hits an opponent who get's KO'd and later dies then it would not be anywhere near a criminal charge as the whole point of boxing is to hit your opponent.

In Rugby. it's more complex as tackling is allowed and, as we have seen recently, tackles can be mis-timed or mis-judged by a fraction and its difference between a good tackle and a red card. I would say it would be case on case and if a rugby player died after a tackle then if it was very tight and no intent then no criminal charge would come.

In the Ice Hockey case I see nothing but manslaughter. Because Hockey is a tough sport which allows charging, slamming and very hard contact. But its all above the waist. You raise your foot that high knowing you've got a blade on the bottom of the boot then, as far as I'm condcerned, you are playing with fire.

Re: Adam Johnson
Vole it non fit injuria is a term which covers the defence by someone engaged in a sport/activity where there is a chance of coming to harm. Boxing for example and contact sports like ice hockey and rugby.

The volenti defence does not absolve the perpetrator because their action has to be reasonable and within the rules/laws of the particular game.

At the very least a civil case against skater who bladed Johnson looks like a win for the plaintiff. That is looking to be after the perp has faced, minimally, a criminal charge of manslaughter.

How long will it be before someone sues an opponent for a Rugby Union head on head tackle?

Re: Adam Johnson
If he meant to harm him by cutting him with the blade of his skate (i.e. wounding with intent), and as a result killed the bloke, that would be murder not manslaughter. You don't have to intend to kill someone to be guilty of murder. However if he meant only to assault him causing minor harm, but in fact inflicted a fatal injury, that would be manslaughter.

Similar experience calling the referee a wanker and drawing my foam finger accross my throat was a bit much for them. I got long looks and 'Buddy love your passion but we dont do that here'

There's a reason Brits aren't allowed to drink in their seats in the UK :-)

Just watched it. Nailed on. Got manslaughter written all over it. His action was with intent to hurt (not kill). That's manslaughter.

I mean, I think he meant to hit him not kill hom, which would be manslaughter. I just don’t think it’ll be proven beyond reasonable doubt that he meant to hit him. Therefore not guilty.

I’m not saying this from a position of no knowledge. As mentioned I played the game and have seen all the mighty ducks movies including having an Anaheim Jersey signed by Emilio Estevez

Manslaughter all day long.

Shut up you cunts. I went to see Chelmsford Chieftains once in the early 1990s and nearly got hit with a puck. Nobody on here has experienced a near death experience at a mickey mouse ice hockey game so I am the only person that can possibly know what Adam Johnson (not the nonce) was going through after he had his neck sliced open and was pissing out blood all over the ice while wearing almost excessive amounts of padding, just in the wrong places.

I can call upon my expert insight and tell you he would have been feeling a bit miffed. Perturbed even.

So shut up the lot of you.

As he's got previous for doing this before, although not connecting to the neck last time, he's clearly a cunt and deserves what he gets.

He lashed out on purpose. He didn’t mean to cut his throat.

He will be found not guilty.

--------------

Isn't that almost the literal description of manslaughter?

'Where an unlawful killing is done without an intention to kill or to cause grievous bodily harm, the suspect is to be charged with manslaughter not murder.'

If he lashed out on purpose then surely he's guilty.
